Japanese Labor law does not cover all legal regualations between employee and employer. Therefore, the employer has the right to add specific job related regulations. If the employee accepts such terms and regualations in the contract, then they are considered part of the laws between the employer and employee.

1- I just came to japan and would like to work, have no visa and no housing...How to work and get a visa?
You are not allowed an income while on a temp or tourist visa. However, you can start work as soon as you apply at the immigration office as long as there is no income until the visa is ready, you do not have any problem. For housing, we provide housing for our company teachers and staff.

2- How much does the housing cost me?
First we try to get you the nearest place to your school or customer location. That will cut the cost of train fare, time and reduce the chances of being late or absent.  In japan, the contract to rent a place requires additional fees, such as appreciation money and head money. The total would be around 3 or 4 months of the monthly rent must be paid in advance. We will pay that cost for your state agency and then divide that amount on your coming salary for 4 or 6 months or more. We do not charge any extra percent and we do not consider that advance as a loan. Other companies take about 8 % on the cash advance and consider it as loan until your debt is paid off. At the end of every school term, the company will recalculate all your paid and given receipts(transportation, housing...etc)  to verify that they are correct. If teacher falsfied any of the receipts, the amount will be dedcuted from last month salary.

3- How long does the visa take in immigration?
The visa takes about 4 to 8 weeks, depends on case by case, the number of applicants and your file requirements. Some cases will finish in 4 weeks and some will be up to 8 weeks.

4- Do I need to pay for the tax while in japan?
Yes you have to pay for your income tax. That is an annual paid monthly. The employer will direct deduct from your salary the amount applicable to your salary. For more details please copy and paste the link below here to see how much is your tax for your salary

5- I do not speak Japanese. Is that a problem?
First of all, working as an English language teacher needs you to speak in English most of the time. you are not supposed to use the Japanese language while at work. If you know some Japanese words, may be would help you but not necessary.

6- I got an apt from the company but after a few months and before I finish my debt, would like to move to another apt. what should I do?
To get the minimum damage, please inform the company ASAP. Please understand you have a one month apt rent deduction after the last day of the current month of rent. Rent contract always requests one month notice. That will be also deducted from your final salary.

7- What are ok's and no ok's at school?
Of course, we should show respect to the Japanese culture and understand the Japanese life style. From this aspect, you as a teacher, as well as all the other school members, are not allowed to wear their shoes inside schools. you will change that with school slippers. also no smoking, inside the schools at all. Please do not use school facilities and equipment for personal use. No personal relationships are allowed with other school member unless allowed by school in groups. for example, welcome party, is ok but do not ask another teacher for a date.... Other related manners will be taught at the training period.

8- When do I get paid my salary? holidays and vacations????
Your salary comes on the 25th of the following month. That is 25 days after the last working day in a pay cycle. Some contracts may state an earlier day for salary. But basic rule is that your salary is never later than 25th of the following month to your work month.The following periods are paid at a 60% of your total income of last 90 days per days x the number of holidays days x 60% as long as you were in japan during the mentioned holiday and were able to work if asked. if you worked any of the days, that working day is paid in full according to your normal salary.August 1st to august 25th. Decemeber from 25th to 30th. January 1st to 4th. Last week in March is paid for fixed salary only(25th to the 30th). Your 60% salary is based on your one month salary for the average of previous 3 months. Net of your 60% after decuting tax, absnet days, and rent *if you live on company apt*.  All Paid vacations Summer/winter are deducted, if empoyee was unable to fulfill 12 months contract in the company, from final salary.  Transportation allowance is not paid if teacher could not work 13 days in one month. 1 month x 60% - tax + rent + absent days, lunch cost...etc = Net to salary.
60% of paid vacation in summer may include work for 10 days, in winter 2 days.

9- How is my salary calculated?
Your salary as a full time person is a certain amount of money promised by the company and will be paid to you according to the following system.
A month of 30 days has 4 weekends, these 4 weekends have 8 holidays. SO you are supposed to  work 22 days out of 30 days. Logically, If you work less, you get paid less. So days that you are absent, or do not go to school are not paid to your salary.
salary - tax then divided by 22 days  X actual working days = Netto salary .         However, you may ask for a salary increase after the first 4 months, and in that case, you have the right for a salary increase if you spent 4 months without any absent/late scheduled work days.

10- What is the dress code?
The dress code of your job is not really specific for a suit, tie and shirt, however, being neat, and wear professionally or at least presentable would be nice. you are not allowed to be wearing casual, showing, tattoos, or piercing.

11- My contract says that I am under the Japanese labor law if any conflict arises. What is the Japanese labor law about?
THere is a link in English to the Japanese standard labor law. according to the Japanese labor law, you should follow the contract terms, If any of the contract terms, violates the Japanese labor law, then that term in the contract, becomes void and null and the labor law becomes effective, However if you signed a contract with the company, You accepted the company system, and rules too.

12- If I join the Labor union, will that affect my relationship negatively with the company?
Of course not, on the other side, we always welcome teachers who joined the union already and we encourage the teachers to join the labor union. That is a safe place to protect your rights against the wrong doings of the wrong doers or employers.

13- If I do not have a housing in or around city of work. Can the company provide me with hotel cost until I get a housing? Also food money? ..etc
The company can help a little bit in the hotel cost of up to 50% for one week maximum until the apt is ready for you to relocate. However, we cannot provide coocking or food money nor clothes money unless the company authorized the employee such a separate deal.

14- I got sick while my visa is in process and I do not have insurance, but I am on contract with the company. I need to go to the doctor but do not have money. What can I do?
While your visa is in process and you have a contract with the company, and you have already started to attend at school, you are covered for health insurance small claims by the company for a maximum of 40.000 yen per month. Includes  visiting the clinic and medical treatments.

15- I have a tourist visa, and would like to rent an apt but it is difficult with Tourist visa. I will be working for this company. How is the rent contract calculated? First of all, the company rents the apt for you. The contract is made in the company name. You or your girlfriend/boy friend or any relative will be the grantor for the apt. If you do not have any one in japan then the company will represent you in all the papers. The rent and the rent contract total cost will be divided on your monthly salary for 4 to 6 months.

16- Summer vacation and winter vacation. Is this paid?
Usually summer vacation is paid less than a normal working month. About 60 % only of your regular monthly salary. However, some contracts do not include summer and winter vacation payment. The day you work, you get paid. SO please check your contract related to this point. Please check questions 6 - 8 above for more details of decutions from final settelment.

17- How about the Bonus?
Bonus is calculated based on your work performance at school, attendance, absence, late, school and classroom activities and so on. If the school likes you as a teacher, sure you will get a bonus. Your bonus is calculated based on 100 % of your salary to a score on the school report. The school report is graded ABCDE where A is 100 % and E is 20%. The minimum your bonus is 20 % and the maximum is 100% of 92% of actual month salary. However, to get your bonus for one year, you have to be working with the company until the day of the bonus payment. That means, when we pay the bonus on May 25th of every year, you need to be working for our company at that time for another one year contract. If you are not working at our company at that time, you right to get bonus is waived and cancelled.
18- The company board of owners and CEO.. Who are they?
The company is owned by shares as it is on public since 2006 October for 20.000 yen a share for 500 shares divided between 4 members. 60% of the shares are owned by a foreigner individual and 40 % are divided among 3 other Japanese members. Mr. Max Ali the owner of the biggest shares and he established the company since 2001/ march, 21st. with a capital of 10 million Japanese yen paid in the Japanese government. The company started as a Limited Company from 2001 to 2006 then October 2006 changed to a corporation in the Japanese stock and shares marker Tokyo Nikkei
19- Some companies pay salary sometimes late and sometimes never. Does this happen in this co.?
The company follows the rules and regulations of the contract between you and the company. Every contract states a specific day to pay for the salary. Please check your bank account on that specific day. Some teachers think that they are getting paid late sometimes because they were paid early in other times. To decide you are being paid late or not, please check the date on your contract. If your  money is not in the bank by that day, then you can claim that the salary is late. This case has never happened with us before. But cases where teachers THOUGHT they are paid late, have happened, later on, we explained to them and the case was cleared out. Our customers are mainly in the public schools and government offices, in that sense, the company will pay you the salary stated in your contract and if the company failed to do so, please go to your school board and claim that. So far, we did not have such claims unless teachers misunderstood the payment date. most of the contracts state 25th of the following month as a pay day. some teacher would think it is the same month of work that they get paid. Here where mistakes of understanding happen. After all, please check your contract, and you can also check with the Japanese labor standards law and the labor office of your city of residence.
One important point that you need to remember, you are supposed to turn in your monthly report by the 5th everymonth for the finished month. If you sent in the monthly report later than the 5th, your salary will be late based on the number of late days. I.E you sent the monthly report on 7th, you get paid 2 days late.

20- How about the overtime?
Your contract system decides the overtime. If you are working on a full time contract, that includes working for 8 or 9 hours a day with 45 to 1 hour break in between. The school will decide if they want to ask you to work some extra days. In that sense, if the school asks you to work extra days, you will be paid overtime if that exceeds your Monday to Friday weekly of 5 days or a maximum of 30 hours a week inside classroom. Overtime is calculated based on 125% of an hour.
21- I live outside japan, can the company sponsor me?
Yes we can sponsor you if you have the minimum requirements of immigration law in japan. For that you need to have a university degree; bring original of your certificate, and at least 2 months time in your visa. Be a native speaker of English language for one of the 42 countries of the English speaking native tongue countries. Other information please check the visa section on our home page.
22- Are there huge deductions from my salary for being late or absent?
The main point is that you should not expect to be paid for a day that you did not work. It is not fair that other teachers are working and you did not work and expect to be paid equally. A day you do not work, is not paid and the time you are late, is not paid either.
we have 2 options here. we choose the less yen cost on your salary to get less damage on your pocket.
A- calculation is based on your salary divided by 22 days = 1 day pay deduction.
B- As per the labor law, Employer has the right of deducting 10 % of your salary cut for that month.
We understand that B might be bigger than A deduction. So usually A deduction applies.
23- How about sick days?
By law you have the right of certain number of days for your working contract, however, Many teachers in the past abused that right. If you are sick and wants to get paid you need to go to the hospital and get a receipt that you have been to the hospital that day during work hours . If you cannot bring a receipt or prescription from the hospital for that day, then the day is calculated as an absent day of work. Any cencelled days by the schools are paid at 11.363 yen per day, however sick day is paid at 8000 yen per day.

24- Do you have any disputes with other teachers at labor office?
Yes there are a few disputes but at a very low level compared with other companies. The disputes are claims from teachers against the company as follows
A-A The very first Dispute was with a female teacher. She applied for work in our company submitting a Resume with few lies in it. At the begining she was working good. But she did not make a health check for over 3 months. We repeatedly asked her to make the health check and she always came up with excuses of every kind. Finally we asked her to make a health check or her contract will be terminated. At the hospital she told the doctor that she cannot make an X Ray on her chest because she is a 4 months pregnant. That was the shock for us. Although we had doubts because she always used Taxi service from school to train station or using a very expensive route. We explained to her and she denied the explanation, that she has no right to use a taxi service every day. She lied to us from the begining when she said that she was ready to work for one year at schools, although she knows that she was already pregnant. Immediate termination of the contract occurred because she violated the contract terms. The Yokohama Immigration office was notified with the case and informed us not to issue a letter of release for her. Case is closed.
A- A teacher claimed that he did not receive his/her resignation letter and therefore, request a one month pay in advance. We had a signed paper by the teacher that the postman had his/her signature when the teacher received the termination letter. In Japanese law, an email, post, letter, or even proven verbal termination is counted. The labor office denied his/her claim.
B- A teacher claimed that his salary is less than the contract.
The teacher submitted a claim to the labor office that he received a less salary than in the contract. We attended the meeting by the labor office staff and showed the time card of the teacher where it shows that he/she worked only 7 days out of 22 days and he still wanted to be paid in full for that said month. Dispute was denied by the labor office.
C- A teacher did not give a resignation letter and just disappeared. Later on, the teacher requested a letter of release from the company. The company refused because he did not follow the contract. The company  has informed the immigration office. Later the teacher claimed damages and the immigration office refused to grant him a renewal of his visa. We had a meeting at the immigration office with the official school report that he just disappeared from work for over 2 months. The immigration office check the report and denied renewal of his/her visa.
2007 CLAIMS AND DISPUTES
D-A A teacher in May 2007, was fired because he posted LIES about the company on the internet. The teacher denied his wrong doings. We confronted the teachers with the evidence that the posts came from him/her. The evidence was a collection of posts, IPS, IP, URL, Resume, C.V tracker, all leading to the same person inclduing his email addresses. We consulted with the labor office and they confirmed that this is enough credible reason. The emaployee was fired in the process. Some teachers know that teacher and they know what he did. They told us that they tried many time to talk with him not to post anything on the internet, but it seemed he thought it will never be known. The teacher informed us with the posts locations and we were able to obtain the related evidence and information. Labor Law act 20-2 gives employers the right to terminate contracts with employees if there is a REASON.
If the posts are not lies, he would not post them, and he will ask the company to correct his claims. He/she said that I know the company will not help me in my claims so I thought to post them on gaijinpot.
If what any post is not true or is considered a lie, which endangers the company image,  the company will check the case and request all evidence from all sources. If found a lie, the person who posts the lies will be subject to adminstritive penality to the limit of contract termination with a reason.

1- COMMON CLAIMS. Several teachers do not want any income tax deductions from the salary and some teachers officially informed us that they do not want to join the social insurance plan, because they do not want to pay their share of it. We as a recruiting company and as we have a recruiting and dispatching license, have to enroll all our teachers in social insurance. so current cases are still not closed.
These are the only 4 disputes we had this year so far among 348 teacher. Again we encourage all teachers in japan to join the union to be able to protect themselves against bad companies and at the same time save the time to talk with labor office. Once you go to the union, the union members will ask us and the problem will be solved at that limit. Most of the cases. teachers misunderstood some line items in contracts or misunderstood the Japanese labor law. Our company will explain your mistakes and if you are still in doubt, you can consult with the labor union and the Labor office.  We will never violate any law in japan nor endorse violation of any Japanese laws. In that sense, if a teacher violated the contract term, we will enforce the labor law upon the teacher, on the other side, if the teacher has a right to claim and that the company was found at fault, we will immediately correct the mistake based on the labor law.

25- Can I receive my contract in any place other than my house, by mail?
No we cannot for the following reasons:
A- Your contract is a confidential document and in some case others have opened the envelope and saw teachers salary and teachers personal bank account information.
B- The contract between the customers and our company always have a law including that we cannot send any thing to the schools other than books and teaching materials. In case we send other things to schools, the school has the right to open the envelope and report to the school board with the contents of the envelopes or items, which later on will be considered a violation of the contract between the company and the customer
To avoid any troubles, make sure you send a correct address in the contract.

26- I want to quit my job right away. what do I loose?
Simply every employee has the legal right to quit working for any employer. However, the law was clear in that point. You should follow the labor law in that matter to make sure you get the minimum damage. If you quit just suddenly without notice as per the Japanese labor law, you will loose 10% of your salary in addition to counting the last working month per days because you did not complete a month.But to avoid any salary cuts or loosing any money, follow your contract terms of termination, and if the contract does not state any, then follow the labor law in that field. Of course, we will not stop you but as much as you expect the company to follow the law for your rights, the company expects you to follow the law also for your rights. please check our labor law section on this web site. there is a link to the Japanese labor law standards. If the employee fails to follow the Japanese labor law, his rights will be waived and canceled. Please also note, that any allowances are not paid in the period after resignation or quitting. (transportation, housing, bonus, incentive...etc are wived and cancelled.

28 - I moved from my housing to anew housing, or changed my information on alien card but did not inform the company, what should I do?
As soon as you change any of the information on your alien card or address, or phone number or bank information, please send us a request to change the information by fax to our company so we can update your file. The company send you every month pay slip, promotions, papers and letters to the address mentioned in your contract. That means you will never receive some of the important documents and pay slips.

29- How much do I get after I move out of company apt?
First of all, Company rented apt is only controlled by the company. You are a guest in the company rented apt. However, as you pay a share in the contract of Real estate agency , you get some money back when leaving. That money is based on the maintenance and cleaning of the apt. If your apt does not need much cleaning, you will get almost the cleaning money back which is about one or two months rent depends on the contract with the agency.

30- Can I have a copy of the rent contract?
The answer is No, if the company rented the apt, you are not allowed the contract copy for 2 reasons
1- It is company apt, nothing is related to you legally.
2- The contracting agency sometimes is strict  to the privacy of information as the contract contains private information on the apt owner and the grantor of the apt, such as name, address, phone and seal. since 2005 April, a new law appeared in japan stating the protection of information of individuals. same as when some one calls us and asks for any private information about you. even we know and we have some information on file, we do not tell any one. It is our responsibility to protect the privacy and the information we have on both sides, you as a teacher and the other side as a customer or a contractor or any third party contracted with us.
The answer is  Yes,  If the contract is in your name and we are the gurnator for you in the real estate agency.

31- Sometimes I do not receive my Tax payment slip or in japan Gensenshoushu..What should I do?
1- The company system is we issue the Gensenshoushu at the end of the year to all teachers or staff or employees. If you want to receive the tax document earlier, please let us know. However, we have come through some cases where they did not recive the gensenshoushu and we already sent to the them. I.E. The teacher changed his/her address and for couple of months did not inform us. That means we sent the Gensenshoushu to the old address. Or the teacher did not request it on time, in other words, the teacher came after 2 years and said I need my gensenshoushu... That means we issued it 2 years ago and that the teacher did not get it. At that case, it is difficult to issue again for double taxation. However, a copy of it is ok not original.
32-I am on a toursit visa, and I applied at the immigration. however, I need some cash to keep me going?
According to the immigration laws and regulations, you are not allowed any income during a tourrist visa term however, you are allowed a transportation cost or if the company has uniform code, then uniform costs as cash advance. as long as the money is not used in the sense of salary. SALARY IS TOTALLY NOT ALLOWED ON TOURIST VISA

33-  Can I have a land line or additional phone line in company rented apt?
Yes if your company rented apt contract is in your name, and No if company rented apt contract is in our name.

34- Can I have my payslips on monthly basis? Yes and No. The Yes part is if you have an approval for that by the company. No, as the company policy states that the pay slips are printed once every 90 days to cover the working period of 3 months. However, the pay slips are not printed while your visa is in process for different reasons, for example, the immigration needs them, or your visa got rejected...etc then we have to submit them to the immigration to declare the amount of income you made during the application process period. If you are on a tourist visa, you are not allowed any salary and therefore not allowed any payslips either.

35- If I leave japan during summer vacation, will my 10 paid days a year vacation, finish?
Labor law gives you 10 days after the first 6 months of work. as a teacher, your contract starts from april . That means,you are not allowed any days off until October , 6 months from contract month. Therefore, when you leave japan during summer vacation, your 10 days are waived out, as we cannot ask for your services due to inavailabitliy point of view. However, if you are still in japan during the summer vacation, you may claim your 10 days as usual and will get them.

36- sick days and paid days. I took 2 days off in the first week of work? How does that affect my bonus and salary, insruance and ...etc?
First of all, you are allowed 10 paid days including 3 sick days in a one year contract after the first 6 months of work. Since you took the days in the first 6 months period, that will negatively affect 2 parts, 1 is your bonus, 2 your paid days.

37- I took a couple of days off for a personal reason, but could not follow the company procedure to send emails, calls, in a proper way to inform the company. how does that affect my bonus?
Of course, not following company policy in informing us with your absence or late times, make you loose bonus points under NOT FOLLOWING COMPANY POLICY and that depends on the case. usually about 50 points per case or more.

38- I want to leave school early every day, for about 30 minutes at the end of school day. There is nothing to do and it becomes boring time for me. Will that affect my bonus or salary? Yes it would, but it depends on case by case

39- I talked with the school, English teacher to leave school early. Is that ok? No, it is not ok, for the following reasons
1- During training we inform all teachers that cases where you have to leave school early, come late, attendance, absence, leave with pay, leave without pay, vacation, visa, salary, immigration, housing, ...etc are issues to be discussed only with the company staff or company coordinators.
2- If the school got the information direct from the teacher, that will be a violation with company policy. You lose 50 Points from bonus. Other points may be deducted from bonus based on the result and consequences of the action the teacher made. For exacmple, if the board of education complained or if the school complained then it is going to be more deduction of points. In addition to that, you are hired by the company not by the school, leaving early, will result in deduction from your salary.

40- I sent the monthly report a bit late.. Will that affect my salary? No It will not make any deductions, may get your paid late, but it will definately affect your bonus points as this falls under adminstrative policy of 50 points deduction from bonus.

41- I was unable to attend the training sessions or part of it. How is that ?
Not attending the training will waive your right in Bonus and you will loose 200 points in the first 3 months of your contract. Loosing over 200 points in the first 3 months of your contract may result in 1- termination of your contract or 2- not getting any salary for summer, winter breaks. The management will decide which route to use.

42- A recent issue appeared as follows. A teacher started working, did not have time to come to sign the contract. Salary day is due. Where is my salary?
To be able to get a salary, you need to have a contract, some official documents that shows the relationship that governs our relationship with you. For accounts section , they need also some details to be delivered to the tax office for your income. That information is always included in your contract wiht the company. such information include, address, alien card number,...etc. Without a contract and a bank account, how can we send a salary??? it is logical issue that you need to have a contract so your name will be in the payroll. FROM OUR EXPEREINCE WITH TEACHERS BEFORE, THE TEACHER WILL NOT SEND A CONTRACT TO PREVENT THE COMPANY FROM DEDUCTING INCOME TAX. THIS IS ILLEGAL AND WE CANNOT ACCEPT.
1- Sign contract... Then H.R will check the information
2- H.R will send the information to the accounts.
3- The account will proceed with Salary. We will need your last company pay of your salary withholding tax statements.
4- you get the salary in the bank
5- Tax office gets informed of your salary points.
You cannot step or over step any of these points for the salary. The company is very careful towards tax issues, as some teachers will try to avoid paying taxes. But from our side, as a responsibility to thte Tax agency of Japan, we have to provide them with the information in full.
Also under labor law, we should have an official documets that governs the relationship between the company and the employee. The official relationship is called CONTRACT.

43- A teacher  working in chiba city, sent us the following:- I did not go to school for 3 days, because my sister came to japan for a visit. Can I still get paid for these 3 days? We are sorry, we will not be able to answer this question, because the answer of the question is already in the question itself...Do you think you should get paid for not showing up at school for 3 days. What should we tell the school,, Please pay the teacher BECAUSE HE WAS ABSENT. It is usually, PLEASE PAY THE TEACHER BECAUSE HE CAME TO SCHOOL....

44- What is the role of the lead teacher? added sept 11th, 2007.
The lead teacher is chosen by majority of the teachers in same city of work to represent their opinions. Teachers may ask him/her first to send us any claims or concerns. The lead teacher then will inform us with your concern. If any of the company policy rules and regulations, or any of the labor law rules and regulations are against the teacher"s will to work, the contract becomes void and invlaid effective that day. Final settelment follows that day to proceed according to labor law.

45- I live far from the school, need a means of transportation. My school is far from my house for over 1 hour. what options do I have?
1- Do not ask the school to get involved in helping you, transporting you, assisiting you in any transportation issues,
2- School teachers, BOE staff are not supposed to get into issues related to meeting you, picking you up to take you to school,...etc
3- School teacher and school head, are responsible for your attendance, but not responsible to bring you to work...
Therefore, please contact your school company coordinator immediately to let him/her know and find a way to assist you.

New update concerning pay slips. Many teachers said they want pay slips on time, some other complained that they did not get, or the postman is late.
1- From November  2007, payslips will be sent by email as an ttachment to file to your PC only email address. That PC email address must be confirmed by the following steps.
A- Teacher will send us an email from his/her cell phone email to inform us with his/her email address.
B- Teacher will send another email from his/her PC email to confirm the same address that was sent from his/her cell phone.
C- The program will automatically send the pay slip to the teachers emails address. 2007/11/09th
